CASES

The cases listed below are illustrative of large zoning and development projects that have been processed for clients of this law firm. In addition, the firm handles the needs of a variety of smaller development projects.

1. American Express Plaza and Desert Ridge Campus (Phoenix): The firm represented American Express in the various stages of zoning, development and project review through the City of Phoenix for that 80 acre, 1.2 million square feet office and industrial project and worked intensively with the State Department of Transportation to secure direct freeway access for their campus at I-17 and Beardsley Road. More recently, the firm assisted American Express again on their new corporate campus in northeast Phoenix in the Desert Ridge core.

2. Desert Mountain, Master Planned Community (Scottsdale): This 8,012 acre master planned community is one of the largest projects of its type in the State of Arizona. The project received zoning approval for 4,700 acres of residential development, 270 acres of resort development, 220 acres of commercial development, over 1,410 acres of golf course and related amenities and over 2,650 acres of natural area open space. The latest amendment to the Master Plan substantially reduced the overall density and obtained approval for an additional golf course (bringing the project total to six golf courses).

3. Biltmore Fashion Park (Phoenix): This luxury regional mall in the heart of Phoenix at Camelback Road and 24th Street has set the standard for elegance and style since it was first built back in the early 1960's. The firm has represented the owners of the mall since 1986 in obtaining the necessary zoning entitlements to expand and update the mall through the years. The firm now represents Westcor Partners in the exciting new revitalization of this highly regarded regional mall into a 21st Century mixed-use masterplan.

4. Scottsdale Fashion Square/Regional Mall and Scottsdale Waterfront Project (Scottsdale): The firm has represented Westcor Partners in renovations and expansions of Scottsdale Fashion Square, Scottsdale's largest regional shopping center. The Fashion Square project includes over 1,500,000 square feet of office, retail, entertainment and hotel uses that were redeveloped under Scottsdale's innovative Downtown Ordinance. The firm also negotiated both the Neiman Marcus Development Agreement and the Scottsdale Waterfront/Nordstrom Development Agreement with the City of Scottsdale.

5. Del Webb's Master Plan Communities of Anthem (Maricopa County), Terravita and Bellasera (Scottsdale), The Foothills (Phoenix), and Sun City Grand (Surprise): The firm obtained the approval of zoning and development entitlements for Del Webb Corporation on its 5,661 acre Anthem master planned community in Maricopa County, including 16,526 residential units, three golf courses and related retail and employment uses. The firm has also represented Del Webb in the zoning entitlements for their major master planned projects at Terravita (800 acre master planned community in north Scottsdale with 1,490 residential units, 18 holes of golf and recreational and commercial amenities), Sun City Grand, The Foothills in Phoenix and Bellasera in north Scottsdale.

6. Arizona Mills (Tempe): The firm represented The Taubman Company and the Mills Corporation in the rezoning of this 120 acre site at the confluence of I-10 and Superstition Freeways for a major Regional Mall exceeding approximately 2 million square feet. The firm's representation included extensive negotiations with the City of Tempe to finalize a development agreement with the City and the Arizona State Department of Transportation for freeway access that provided the necessary financial incentives to enable the regional mall to move forward. It opened in November, 1997.

7. Papago Park Center (Tempe): The firm represented Salt River Project (S.R.P.) in the Master Plan rezoning one of the largest office and industrial master plans approved in the State of Arizona. This project's approvals totaled 9.2 million square feet of office, industrial, research and development and retail space, including S.R.P.'s Corporate Headquarter Complex.

8. The Phoenix Plaza/Northeast Corner of Central & Thomas (Phoenix): The firm represented The Koll Company and BetaWest in the zoning and development review process for this major mixed-use, high-rise commercial project, with 1,500,000 square feet of office, a 225 room hotel and 90,000 square feet of retail space.

9. Stardust Development, Inc: The firm has represented Stardust Development, Inc. in obtaining zoning and development entitlements for scores of beautifully designed residential master plans throughout the Valley and state. The most notable of the recent master plans are Tartesso (approximately 10,000 acres) in Buckeye, Rancho Gabriela (800 acres) in Surprise and Dreaming Summit (607 acres) in Maricopa County.

10. Douglas Ranch (Buckeye): The firm represented JDMD in obtaining the land use entitlements and development agreement for this major community master plan in the Town of Buckeye of more than 35,000 acres. This is a balanced community plan providing a full range of housing types, shopping, employment, recreation and a full spectrum of open space amenities. It will be the largest master planned community in Arizona History.

11. Environmentally Sensitive Lands Ordinance (Scottsdale): On behalf of clients in North Scottsdale, the firm was a major participant in drafting Scottsdale's Environmentally Sensitive Lands Ordinance and has worked on all subsequent amendments to the Ordinance. Participation by the firm has helped ensure the appropriate balance between preservation and protection of environmental resources and legitimate private property rights.
